1. Introduction & Acceptance of Terms

Welcome to BEKUU. These Terms and Conditions ("Terms") constitute a legally binding electronic agreement between you ("User", "Customer", or "Professional / Partner") and BEKUU Technologies ("BEKUU", "we", "us", or "our"), governing your access to and use of bekuu.in, our mobile applications (BEKUU: Home Services and BEKUU Partner), and associated services (collectively, the "Platform").

By accessing or using the Platform, downloading our mobile applications, or creating an account, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Platform.

2. Intermediary Status & Independent Provider Relationship

BEKUU is an electronic marketplace and technology intermediary, operating under Section 79 of the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020.

The contract for the provision of home services, on-site diagnostics, repairs, or materials is entered into directly between the Customer and the selected independent Professional. BEKUU facilitates discovery, scheduling, price communication, in-app approval for scope changes, and payment settlement.

3. Eligibility & Account Creation

• You must be at least 18 years of age and legally competent to enter into contracts under the Indian Contract Act, 1872.
• You must provide accurate, current, and complete registration information during email OTP verification.
• You are responsible for safeguarding access to your registered email account and device. Any activity initiated through your verified account is deemed your responsibility.

4. Service Catalogue & Professional-Specific Pricing

• Indicative Catalogue Rates: Rates displayed on public overview screens represent baseline reference rates. They do not bind any specific independent professional.
• Specialist-Listed Rates: Each independent professional sets their own specific price for offered services. Customers review the selected professional's rate before submitting a booking request.
• Fixed Price Jobs: For services designated as Fixed Price, the listed rate covers the standard agreed scope of the service.
• Estimate-Based Jobs: For complex or exploratory services, the listed amount represents a starting diagnostic estimate. Final scope and costs are established on-site after physical inspection.

5. Scope Changes & Approval-Based Extra Work

To prevent unexpected charges, BEKUU enforces an approval-first workflow for any work exceeding the initial booking scope:

• A professional cannot perform or bill for extra work without submitting a formal Extra Work Request via the Partner app.
• The Extra Work Request must describe the necessity, provide cost itemization, and include photo evidence where applicable.
• The Customer has sole discretion to approve or decline the extra work request in the app.
• If declined, the professional shall only complete the original agreed service, and the Customer will only be charged the original booking amount.

6. Booking Lifecycle & Cancellations

• A booking request is subject to acceptance by the selected professional based on availability.
• Customers may cancel a requested or accepted booking prior to professional arrival through the app without penalty.
• Professionals may decline or cancel a booking if an emergency arises or if the service location is inaccessible.

7. Payments, Platform Fees & Invoices

• Payments may be completed through authorized online payment methods (UPI, debit/credit cards via our integrated payment gateway, Razorpay) or cash on doorstep where supported.
• All prices and invoices are issued in Indian Rupees (INR) calculated to exact minor units (paise).
• A digital invoice is made available in the customer's app history upon job completion.

8. Professional Verification & Qualifications

Professionals on BEKUU submit government-issued identity proof and trade experience details prior to approval. However:

• Verification confirms the submission of identity credentials and trade representations at the time of review.
• Customers should exercise normal prudence regarding personal safety, valuable household belongings, and premises supervision while work is carried out.

9. Prohibited Conduct

Users of the Platform agree NOT to:

• Provide false, misleading, or fraudulent identity or booking information.
• Circumvent the platform by soliciting private offline transactions to evade dispute resolution protections.
• Harass, abuse, discriminate against, or endanger any customer or service technician.
• Reverse engineer, decompile, scrape, or tamper with the Platform’s software or security measures.

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

• BEKUU acts solely as a technology facilitator and is not liable for the actual physical workmanship, acts, errors, or omissions of independent service professionals.
• BEKUU shall not be liable for indirect, incidental, punitive, or consequential damages arising from the use of the Platform.
• Nothing in these Terms limits liability for gross negligence, willful misconduct, or liabilities that cannot be excluded under applicable consumer protection legislation.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts in Belagavi, Karnataka, India.
